Yes. Most independent and non-denominational churches are nonprofit corporations that can be sued like any other organisation. Many also carry liability insurance that covers abuse claims.
Is the wider denomination responsible for abuse in a local church?
It depends on how the denomination is organised. Where a regional or national body appoints, trains or disciplines pastors, it may share liability. Where each congregation governs itself, the claim usually focuses on the local church and its leaders.
Can a church use religious freedom to avoid an abuse lawsuit?
Generally no. Courts routinely hear negligence claims against churches for failing to protect people from sexual abuse. The First Amendment only limits claims that would require a court to decide questions of religious doctrine.
Does church insurance pay abuse settlements?
Often, yes. Many churches carry general liability or sexual misconduct coverage, and insurers frequently fund settlements. A lawyer can find out which policies were in force when the abuse happened, even if it was decades ago.
Can I bring a claim against a megachurch or multi-site church?
Yes. Large churches and multi-site networks are usually incorporated and insured. Their central leadership may be liable if it controlled hiring, training or supervision at the campus where the abuse happened.
What if the pastor who abused me moved to another church?
You can still bring a claim. If the first church knew about the abuse and let the pastor move on without warning others, that can strengthen the case against it.
